Terms of Service

The terms that govern your use of DAKAEi, covering accounts, subscriptions, acceptable use, AI output, connected apps, and liability.
Agreement
These Terms are an agreement between you and DAKAEi Technologies Ltd ("DAKAEi", "we", "us"), a company registered in England and Wales, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. They apply whenever you use the service.
By creating an account or using DAKAEi, you accept these Terms. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation.
The Privacy Policy, Acceptable Use Policy, Cookie Policy, Refund Policy, and any feature-specific terms form part of this agreement.
Eligibility and accounts
You must be at least 16 years old, and old enough to enter a contract where you live.
You are responsible for your account, for keeping your credentials secret, and for everything that happens under it. Tell us promptly if you think it has been compromised.
One person or organisation per account. Do not share a single account across people in a way designed to avoid per-seat pricing.
The service
DAKAEi is an AI assistant. It answers questions, works with files, carries out tasks in the apps you connect, runs automations you configure, can be spoken to by voice, and can fetch live information from external sources you enable.
We develop the product continuously. Features may be added, changed, or withdrawn. If we withdraw something you are actively paying for, we will give you reasonable notice.
Availability is not guaranteed. We aim for a reliable service but do not promise uninterrupted access.
Plans and billing
Paid plans are billed in advance on a recurring basis until cancelled. Prices are shown at checkout and exclude taxes unless stated.
Subscriptions renew automatically for the same period. You can cancel at any time; cancellation takes effect at the end of the period you have already paid for.
Plans include a monthly allowance. Allowances reset each billing period and do not roll over. Where a feature consumes an allowance, the amount consumed is shown to you before or as it is used.
We may change prices. Existing subscribers will be told before a change applies to their renewal.
Failure to pay may result in suspension or downgrade of your account.
Your content
You keep ownership of everything you put into DAKAEi, including your messages, files, instructions, and agents.
You grant us the licence needed to operate the service: to store your content, transmit it, and process it in order to generate responses and carry out the tasks you ask for. That licence exists only to run the product for you and ends when you delete the content.
You are responsible for having the right to put content into DAKAEi, including anything you bring in from a connected app or a shared workspace.
As between you and us, output generated for you is yours. Similar or identical output may be generated for other users, and we make no claim that output is unique.
AI output
DAKAEi produces machine-generated output. It can be inaccurate, incomplete, or misleading, and it may state wrong things convincingly.
Output is not professional advice, whether legal, medical, financial, or otherwise. Do not rely on it as such.
You are responsible for reviewing output before acting on it, and entirely responsible for actions you authorise the assistant to take on your behalf, including messages it sends and changes it makes in your connected apps.
Automations act without you present, on rules you set. Review them.
Connected apps and external data
Connecting an app authorises us to access it on your behalf, within the permissions you granted, to carry out what you ask for.
Your use of any connected app is still governed by your agreement with whoever provides it. We are not responsible for those services, their availability, or what they do with data you keep in them.
Some features fetch live information from external sources. You are responsible for using that data lawfully, including complying with the terms of the site it came from and with data protection law when the data concerns identifiable people.
We may limit how much of these features you can use, to protect the service and manage cost.
Acceptable use
The Acceptable Use Policy sets out what you may not do with DAKAEi. Breaking it is a breach of these Terms.
We may suspend or terminate an account that breaches it, and may do so immediately where there is a risk to other users, to the service, or to someone's safety.
Our rights
We own the service, including the software, models we build, interface, branding, and documentation. Nothing here transfers that to you.
You may not copy, resell, reverse engineer, or build a competing product from the service, except where that restriction is unenforceable where you live.
If you send us feedback, we may use it without obligation to you.
Suspension and termination
You can stop using DAKAEi and delete your account at any time.
We may suspend or end your access if you breach these Terms, if we are required to by law, or if continuing would create a serious risk. Where circumstances allow, we will tell you first.
On termination your right to use the service stops. We will delete your content in line with the Privacy Policy. Terms that by their nature should survive, such as ownership, disclaimers, liability, and governing law, remain in force.
Disclaimers
The service is provided "as is". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or that output will be accurate or suitable for your purpose.
Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Indemnity
You agree to indemnify us against claims arising from your use of the service in breach of these Terms, from content you put into it, or from your use of data the service fetched for you.
Changes, law, and contact
We may change these Terms. Material changes will be notified in the product or by email before they take effect. Continuing to use DAKAEi after that means you accept the new version.
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer you may also bring proceedings in the country where you live, and mandatory consumer protections available to you there are unaffected.
